1. Acceptance of Terms

By accessing or using this website, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use this website. These Terms & Conditions and the provision of goods and services by Neospace International Limited trading as Matisse ("Matisse") are governed by, and interpreted in accordance with, the laws of New Zealand.

2. Copyright

All website design, text, graphics, interfaces, and the selection and arrangement thereof are © Neospace International Limited. All rights reserved. Any use of materials on this website, including reproduction, modification, distribution or republication, without prior written permission from Matisse is strictly prohibited.

3. Disclaimer

All information, services, products and materials on this website are provided on an “as is” basis without warranty of any kind. To the maximum extent permitted by law, Matisse disclaims all representations and warranties, whether express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer viruses, and warranties arising from course of dealing or performance.

Matisse does not warrant that the information on this website is accurate, complete or current. Prices and availability are subject to change without notice.

4. Limitation of Liability

To the maximum extent permitted by law, Matisse shall not be liable for any direct, indirect, incidental, special, punitive or consequential loss or damages arising out of or in connection with your use of, or inability to use, this website or any goods or services supplied through it, even if Matisse has been advised of the possibility of such damages.

Some jurisdictions do not allow limitations or exclusions of liability, so these limitations may not apply to you.

This website may contain links to third-party websites ("External Sites"). Matisse is not responsible for the availability, content or accuracy of any External Sites and does not endorse them. Access to External Sites is at your own risk.

 

ONLINE SALES TERMS & CONDITIONS

6. Online Sales

Online sales are subject to these Terms & Conditions between Neospace International Limited (trading as Matisse) and the customer ("Customer").

7. Pricing

All prices are in New Zealand dollars (NZD) and include GST unless stated otherwise. Prices exclude delivery charges. Matisse reserves the right to amend prices or cancel orders where a pricing error has occurred.

8. Payment

We accept Visa and Mastercard. Online payments are processed by Shopify Commerce Singapore Pte Ltd (processing fees may apply). By making a purchase, you acknowledge that payment information is handled in accordance with Shopify’s privacy policy.

9. Returns & Refunds

Online sales are final. Returns or refunds will only be considered where goods are defective, damaged, not as described, or otherwise covered under the Consumer Guarantees Act.

Requests must be submitted in writing to accounts@matisse.co.nz within 7 days of delivery.

At Matisse’s discretion, goods may be accepted for credit subject to:

• A restocking fee (typically 15% of the invoiced value)
• Return of goods in original condition
• All freight costs being borne by the Customer

10. Shipping & Delivery (Online Orders)

Shipping fees are calculated at checkout. Standard delivery is to door, ground floor only, and excludes unboxing, rubbish removal or assembly.

Orders are generally dispatched within 1–3 business days of payment. Delivery timeframes are estimates only and may be delayed due to courier or external factors.

Matisse reserves the right to cancel an order where delivery costs are unusually high or delivery is impractical (e.g. remote locations).

Additional conditions:

• Delivery to PO Boxes is not available
• A physical address and contact phone number are required
• Delivery is available within New Zealand only

11. Order Pick-Up

Pick-up is available from the Auckland Warehouse (Mt Wellington) only. Customers will be notified when orders are ready (typically 1–3 business days). Proof of purchase and photo ID are required. Customers must wait for confirmation before collection.

Some items may be oversized and unsuitable for car or SUV transport. Customers will be advised in advance.

12. Receiving of Goods

Customers must inspect goods on delivery. Any damage, shortage or issue must be:

• Noted on the delivery receipt (where unpacking is permitted), and
• Reported to Matisse within 24 hours of delivery.

Failure to notify Matisse within this timeframe may result in the claim being declined.

13. Materials & Finishes

Samples, swatches, images and descriptions of fabrics, leathers, timber, stone and finishes are indicative only. Natural variations may occur between samples and final products and also from order to order.

14. Deemed Acceptance (Online Sales)

Payment for an online order constitutes deemed acceptance of these Terms & Conditions.

 

GENERAL SALES TERMS & CONDITIONS (NON-ONLINE SALES)

15. Delivery

Delivery times for indent orders vary by product and manufacturer and are estimates only. Delays outside Matisse’s control will be communicated where possible. Delivery charges are additional and payable by the Customer.

Delivery is to a single nominated location. Additional charges may apply for difficult access, multiple locations or specialist equipment (e.g. cranes).

16. Customer Own Material (COM)

Customers supplying their own fabrics or finishes are responsible for quality, quantity and delivery to the manufacturer. All associated costs (materials, freight, duties, taxes) must be paid in full prior to order placement. COM items are supplied at the Customer’s risk and are not warranted by suppliers. The manufacturer may reject the material and this, together with the costs involved, are at the Customer’s own risk. Lead times may increase for COM orders.

17. Payment Terms (Non-Online Sales)

A 50% non-refundable deposit is required on order confirmation. Orders will not be placed until the deposit is received. The balance is payable prior to delivery.

If delivery is delayed at the Customer’s request, storage charges may apply and full payment remains due on invoice.

18. Title & Risk

Title to goods does not pass to the Customer until payment is received in full. Matisse reserves the right to repossess goods in the event of non-payment, insolvency or default. The Customer is liable for all reasonable recovery and legal costs.

19. Deemed Acceptance (General Sales)

Payment of the deposit constitutes deemed acceptance of these Terms & Conditions and confirmation that the sales order is accurate and complete.

 

PRIVACY & PERSONAL INFORMATION

20. Collection of Personal Information

Matisse collects personal information including names, contact details, order information and website usage data for lawful business purposes such as order processing, delivery, customer communication, service improvement and legal compliance.

21. Marketing Communications

Marketing communications are sent only where consent has been provided or where otherwise permitted by law. All communications include an unsubscribe facility. Transactional communications relating to orders or accounts may still be sent.

22. Third-Party Providers & Overseas Disclosure

Matisse uses third-party providers including Shopify (e-commerce and payments) and Klaviyo (email and SMS marketing). Personal information may be processed or stored overseas, including in the United States. Reasonable steps are taken to ensure compliance with the Privacy Act 2020.

23. Cookies & Tracking

This website uses cookies and similar technologies to enable functionality, analyse usage and support marketing and personalisation. Use of this website constitutes consent to such technologies in accordance with applicable laws.

24. Access, Correction & Complaints

Customers may request access to or correction of their personal information, or make privacy complaints, by contacting Matisse via the details on this website. Requests are handled in accordance with the Privacy Act 2020.

25. Data Security & Retention

Matisse takes reasonable steps to safeguard personal information and retains it only for as long as necessary or as required by law.
